1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of TranscribeKit ("the App"), developed by IAM_DEV ("we", "us", or "our"). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use TranscribeKit on Windows devices you own or control, solely for your personal or internal business purposes.
You may not:
- Reverse engineer, decompile, or disassemble the App
- Sell, sublicense, or redistribute the App or any part of it
- Remove or alter any proprietary notices in the App
- Use the App in any way that violates applicable law
3. Permitted Use
TranscribeKit is provided as a tool to transcribe, edit, translate, and export audio and video content. You are solely responsible for:
- Ensuring you have the right to transcribe any audio or video content you process
- Complying with copyright, intellectual property, and privacy laws applicable to your content
- How you use, publish, or distribute any transcriptions or exports generated by the App
4. Third-Party Services
The App's optional AI translation and proofreading features use OpenRouter, a third-party API service. By configuring and using these features, you also agree to OpenRouter's Terms of Service. We are not responsible for the availability, accuracy, or content produced by third-party AI services.
Whisper models are sourced from Hugging Face's public model hub. Their use is subject to the respective model licenses (typically MIT or Apache 2.0).
5. Disclaimer of Warranties
TranscribeKit is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The App will be error-free or uninterrupted
- Transcription results will be accurate or suitable for your purposes
- The App will meet your specific requirements
Transcription accuracy depends on audio quality, language, accent, and the Whisper model selected. Always review transcriptions before using them for professional, legal, or critical purposes.
6. Limitation of Liability
To the maximum extent permitted by applicable law, IAM_DEV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of business, arising from your use of or inability to use TranscribeKit.
Our total liability for any claim related to the App shall not exceed the amount you paid for the App (which is zero, as it is free).
7. Intellectual Property
TranscribeKit and its original content, design, and code are the property of IAM_DEV. The Whisper AI model is developed by OpenAI and used under its open-source license. All third-party trademarks, logos, and names belong to their respective owners.
8. Updates & Changes
We may update the App or these Terms at any time. Material changes to the Terms will be communicated through the App's release notes. Continued use of the App after an update constitutes acceptance of the revised Terms.
We reserve the right to discontinue or modify the App at any time without notice.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved in the applicable jurisdiction.
